Those who love problems
I was not aware that 'trademarks' had crept into the Bromeliaceae field
until I read about happenings in New Zealand. We have Neoregelia 'Debbie'
which is a legitimate Cultivar name and can be freely used by all and a
Neoregelia 'Deb' said to be trademark in New Zealand which cannot be
freely used by all. Not knowing the exact restrictions of the trademark
concerned I assume the name cannot be attached to offsets! Because it is
not recognised as a Cultivar name I also assume that a Neoregelia 'Deb'
would be treated as a 'Not according to schedule' on the Show bench!
As Registrar I am instructed to stay clear of trademarks and to show my
ignorance in this field the only trademark I had heard of before called
'Deb' referred to dehydrated potato flakes. I can understand the use of
trademarks for consumable items that are truly consumable by humans but
cannot understand the logic for plants that can be replicated asexually.
I intend to put the enclosed into Cultivar Corner in http://BSI.org
Uncle Derek
